END-USER LICENSE AGREEMENT

EFFECTIVE: FEBRUARY 12, 2025

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Circle Fillers ("Developer") for the Circle Filler mobile application ("Application").

1. LICENSE GRANT

The Developer grants you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the Application on mobile devices that you own or control, strictly in accordance with this Agreement and applicable law.

2. LICENSE RESTRICTIONS

You agree not to:

  • Copy, modify, or distribute the Application or any portion thereof
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application
  • Rent, lease, lend, sell, sublicense, or transfer the Application to any third party
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Application
  • Use the Application for any unlawful purpose or in violation of any applicable laws or regulations
  • Use the Application to develop a competing product or service

3. INTELLECTUAL PROPERTY

The Application, including all content, features, functionality, graphics, and design elements, is owned by the Developer and is protected by copyright, trademark, and other intellectual property laws. This Agreement does not transfer any ownership rights to you.

4. UPDATES

The Developer may release updates, patches, or new versions of the Application from time to time. Such updates may be required for continued use. The Developer is under no obligation to provide updates or to continue supporting any version of the Application.

5. DISCLAIMER OF WARRANTIES

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.

7. TERMINATION

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and delete all copies from your devices.

8. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

9. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and the Developer regarding the Application and supersedes all prior agreements and understandings, whether written or oral.
